Probate Attorneys in Tampa

Legal Help in the Administration of Florida Probated Estates

When a person passes away, his or her estate must be handled through the court process called probate unless legal steps, such as a living trust, have been previously established. Probate is a process subject to Florida law in which the decedent’s property and assets must be gathered together as well as any taxes, debts, or other liabilities that will need to be paid off. Once all of that is done, what remains in the estate is distributed to the estate’s heirs according to probate law.

If you are a family member, friend, or personal representative who needs legal assistance with any aspect of a probated estate, Four Rivers Law Firm is here to serve you. Our firm provides legal guidance for personal representatives (executors) as well as representation for heirs and beneficiaries who may have legal issues with estate administration. With decades of legal and trial experience and efficient digital technology that streamlines the documentation process, our services are affordable and competent.

Florida Probate

Various types of probate exist in Florida, depending on the value of the estate. Estates valued above $75,000 must go through what is called a Formal Administration. Estates of lesser value may be probated with a Summary Administration or a Disposition Without Administration, depending on relevant circumstances.

In the probate process, a personal representative is assigned by the court whose job is to collect all assets, pay taxes and liabilities, distribute the remainder to heirs, and make a final accounting to the court.

Assets that typically go through the probate process include:

  • Real estate
  • Checking and savings accounts
  • Retirement accounts
  • Life insurance policy benefits
  • Vehicles
  • Investment portfolios
  • Other valuables, such as jewelry, art, collectibles, etc.

Sometimes, federal and state estate taxes must be filed. In other instances, heirs, beneficiaries, and creditors may make claims against the estate which must be resolved before probate can be concluded.

Probate can be a time-consuming and complex process. The attorneys at Four Rivers Law Firm have a deep familiarity with all aspects and can help ensure that your probated estate is handled with the care and attention it deserves.
